Buyer due diligence should be performed, to ensure the property meets their needs and criteria. Including but not limited to any need to contact necessary person(s)/office(s) with regards as to building restriction(s)/question(s), water, electric accessibility and the like. Buyer to hold seller harmless for any misinformation contained herein as seller may or may not have actually visited the property and has had no survey. Seller's sole responsibility is to provide parcel's legal description, APN and parcel's general location. Any other information contained herein must be independently verified by buyer as rules/regulations may and can change over the years. Real estate taxes are current as of last bill sent and will not be prorated. Financed owners will be responsible for the tax bill for the periods during the agreement period.
Aerial photos indicate the general area where the lot is located and photos are not guaranteed to be 100% accurate, but are shown for general informational purposes and a guideline only. It is buyer's responsibility to physically visit property or make other inquiries as to determine exact parcel's location.
Should buyer desire to use an outside escrow company or independent third party any attorney’s fees, associated costs, including but not limited to, deed preparation, closing fee, title research, title insurance fees and any and all associated premiums and dues, will be borne by the buyer.
Immediate Payment -Full Ownership
Full payment of purchase price plus any indicated paperwork fees is due within 72 hours after sale agreement or auction's end. Buyer is required to email contact information and their intentions to buy immediately in order for the property status to be considered as a pending sale. This contact information must include: (1) Full legal name(s) of grantee(s) exactly as they are to appear on the deed, (2) Desired vesting: (example, John Q. Doe and Mary A. Doe, HUSBAND AND WIFE AS JOINT TENANTS), (3) Mailing address where you want future tax bills and deed to be sent, (4) email address, (5) Daytime telephone number. (6) Method of payment. This information is required immediately for preparation of the deed and any written agreement.
Bidding for Down Payment Auctions
Full payment of the down payment is due within 72 hours after entering preliminary agreement and/or upon auction's end. Upon receipt of the down payment our land purchase agreement will be drafted and sent. Upon receipt of the signed agreement, we will return scanned copy via email and original signed version by U.S. Mail. Monthly invoices will be emailed for payments, with the terms specified below.
Terms for Purchase Agreements
We ask that if you don’t fully understand the agreement to please seek legal advice from your attorney before signing. The purchase agreement is effective the date signed by both parties and is effective as long as both parties are still within the terms of the agreement.
The agreement states, that the Purchaser has examined this property, performed due diligence, and agrees to accept same in its present condition, as is and where is with no warrantees expressed or implied.
Possession of the property shall be delivered to purchaser upon date entered into agreement. Purchaser accepting possession indicates they agree to pay for any applicable dues, taxes and/or fees owed on the property upon taking possession except not including any applicable dues, taxes and/or fees generated before taking possession.
In the event of breach of this contract by Purchaser, Seller may at its option (a) accept any money received from Purchaser as liquidated damages and this contract shall then be null and void; (b) enter suit in any court of competent jurisdiction for damages; or (c) enter suit in any court of competent jurisdiction for specific performance.
In the event of breach of this contract by Seller, Purchaser may at its option (a) accept return of any money paid to Seller as liquidated damages and this contract shall be null and void; or (b) enter suit in any court of competent jurisdiction for damages, less credit for any money returned to Purchaser; or (c) enter suit in any court of competent jurisdiction for specific performance.
If it becomes necessary to ensure the performance of the conditions of this contract for either party to initiate litigation, then the losing party agrees to pay reasonable attorney's fees and court costs in connection therewith to the prevailing party.
Purchaser is in default upon late or missed payment, to get out of default purchaser must pay all past due owed and bring loan current. With any past due amount, the purchaser is considered in default.
After 90 consecutive days of default, all rights to property revert to seller with purchaser forfeiting any interest whatsoever including but not limited to any payments, improvements, or possessions therein and this contract shall then be null and void.
Purchaser is responsible for any liability after possession and/or upon entering into this agreement.
Ownership Transfer Process
Upon completion of payments per amortization schedule in the agreement Seller to furnish Grant Deed conveying all ownership rights of said property to Purchaser. The agreement has come to completion upon full payment to Seller and transfer of deed to Purchaser.
Reasonable time shall be given for examination of title. Should examination of title reveal defects which can be cured, Seller hereby obligates himself to cure same as expeditiously as possible and to execute and tender deed in accordance with the terms herein. Purchaser will provide seller with vesting information within 30 days of payoff and/or before requesting title conveyance to ensure deed is vested as Purchaser desires. Title conveyance shall be completed by Seller and sent to Purchaser to be recorded with office or recorder of said county within 30 days of completion of payments and receipt of vesting information.
The contract shall not be assignable by Purchaser without Seller's prior written consent, which consent may be withheld for any reason.
